Conforme al Reglamento 2016/679, de 27 de abril, de Protección de Datos de Carácter Personal y Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y Garantía de los Derechos Digitales, LEXLAND MARBELLA, S.L, en adelante, LEXLAND MARBELLA, pone a disposición del interesado información adicional referente al tratamiento de datos de carácter personal.

Access to this website is unrestricted and free of charge. The personal data provided will be kept strictly confidential. The data provided by the user will be included in our records of processing activities and processed pursuant to Regulation 2016/679, of 27 April, on Personal Data Protection, and Organic Law 3/2018, of 5 December, on Personal Data Protection and Guarantee of Digital Rights.

LEXLAND MARBELLA se compromete a cumplir con el deber de secreto de tales datos, así como a tratarlos con confidencialidad, asumiendo las medidas necesarias para evitar su alteración, pérdida, tratamiento o acceso no autorizado, tal y como se recoge en el Reglamento (UE) 2016/679 del Parlamento Europeo y del Consejo, de 27 de abril de 2016, relativo a la protección de las personas físicas en lo que respecta al tratamiento de datos personales y a la libre circulación de estos datos y en la Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y Garantía de los Derechos Digitales.

As stipulated in GDPR (EU) 2016/679 you can exercise your rights to access, rectify, erasure, limitation, portability and objection before the company and even, should you consider it necessary, before a Supervisory Authority (in this case the Spanish Data Protection Agency (Agencia Española de Protección de Datos) as Principal Authority):

  • Right to rectification (GDPR Art. 16) “The data subject shall have the right to obtain from the controller without undue delay the rectification of inaccurate personal data concerning him or her.  Taking into account the purposes of the processing, the data subject shall have the right to have incomplete personal data completed, including by means of providing a supplementary statement”.

     

  • Right to erasure (“right to be forgotten”) (GDPR Art. 17): “The data subject shall have the right to obtain from the controller the erasure of personal data concerning him or her without undue delay (

     

  • Right to restriction of processing (GDPR Art. 18): “The data subject shall have the right to obtain from the controller restriction of processing (…)”

     

  • Right to data portability (GDPR Art. 20): “The data subject shall have the right to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used and machine readable format and have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided (…)”.

     

  • Right to object (GDPR Art. 21): “The data subject shall have the right to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her (…)”

 

The aforementioned data subject rights may be exercised directly by the data subject or through a legal representative or volunteer.

  1. APPLICABLE LEGISLATION.

 

The basic regulations to be taken into account by online service providers are as follows:

 

  • Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing directive 95/46/EC (General Data Protection Regulation).

  • Organic Law on Personal Data Protection and Guarantee of Digital Rights (Spanish acronym – LOPDGDD) transposes to Spanish law the model established by the General Data Protection Regulation (GDPR) and introduces new features by developing the matters contained therein.

 

  1. DISPUTE RESOLUTION PLATFORM.

 

Under Article 14.1 of Regulation (EU) 524/213 of the European Parliament and of the Council of 21 May 2013, on online dispute resolution for consumer disputes and amending Regulation (EC) No. 2006/2004 and Directive 2009/22/EC (Regulation on consumer online dispute resolution), the website provides, where needed, the platform for online dispute resolution.

  1. GOVERNING LAW AND JURISDICTION.

 

The applicable law in the event of dispute or disagreement over the interpretation of the terms of this privacy policy and legal notice and any issue related to the services on this website shall be Spanish law.

 

  1. CHANGES TO THE PRIVACY POLICY.

 

LEXLAND MARBELLA reserves the right to modify its data protection policy as it deems fit, or because of a change in the legislation, case law or business practice. If LEXLAND MARBELLA makes a change, the new text will be published on this website where the user may find out about the data protection policy. In any event, the relationship with users shall be governed by the rules in force at the time of access to the website.
